ZONING BOARD OF APPEALS

Minutes                     1                          September 6, 2012

MEMBERS PRESENT:        Thomas Berstene, Stephen Wagner, Teri Dickey-Gaignat

The following are motions made during the September 6, 2012 Public Hearing/Regular Meeting.

Public Hearing

Chairperson Berstene called the public hearing to order at 7:37 pm in the Madden Room.

The recording secretary read the legal notice into the record as it was published in the Journal Inquirer on Saturday, August 25, 2012 and Saturday, September 1, 2012.

Appl. 2764-12 – J.E. Shepard Co./Tim Shepard - request for 39.2 foot variance to Table 3.1.2A to allow lot widths of 160.8 feet (200 ft. required) for properties located at 140 Pleasant Valley Road and 156 Pleasant Valley Road, A-40 zone.

James King represented the applicant, Tim Shepard, owner of 156 Pleasant Valley Road.  Dorothy Pysh was also in attendance as the owner of 140 Pleasant Valley Road.  In 2003, the original oversized lot was subdivided into 2 undersized lots - 3 variances were granted for this purpose.  The applicant stated that their intent at this time is just to straighten the property line between the two parcels to be perpendicular to Pleasant Valley Road.  Both lots will remain the same size they are currently.   The variance request was due to the lot widths being less that the 200 feet required by regulation.  There would be no other changes and both owners are agreeable to straightening the property line.

After questions and discussion, the Commissioners determined that clarification was needed on some of the information provided, additional information was needed and possibly more accurate information was needed.  Issues included:  questions regarding hardship, motivation for the line change, proximity of the wetlands on 156 Pleasant Valley, and need for the variance.  Mr. King and Ms. Pysh stated that they had no objection to having the public hearing continued to the October meeting date.

Motion to: keep the Public Hearing open until the next regularly scheduled meeting on October 4, 2012

Commissioners continued to discuss the application;

Vote:  unanimous

Discussion ended at 8:15 pm.

Other Business:  

Chairperson Berstene informed the Commission that Commissioner Stephen Wagner is resigning from the Zoning Board of Appeals due to his appointment to the Planning and Zoning Commission – tonight is Steve’s last meeting for ZBA.  Joseph Kennedy will assume Commissioner Wagner’s remaining term on ZBA.  Commissioner Wagner stated that in the 12 years he was on ZBA he learned a great deal about the Town and the regulations governing the Commission, and that he appreciates all the other Commissioners’ contributions and accomplishments.

Vote:  unanimous, with Wagner abstaining due to absence from 5/30 meeting

Vote:  unanimous, with Dickey-Gaignat abstaining due to absence from 6/7 meeting
